These general terms and conditions of sale (hereinafter: GTC) of the company Just On Time Sàrl (hereinafter: JOT) govern the rights and obligations arising from the relationship between JOT and its customers under contracts concluded via the online shop on the website http://www.justontime.ch (hereinafter: www.justontime.ch).
The GTC are applicable in the version in force at the time the contract is concluded.
The online shop is only available to customers whose domicile or delivery address is in Switzerland.
Customers are free to register on the www.justontime.ch website or to place an order without registering. In all cases, the customer is obliged to provide accurate personal data.
JOT reserves the right to delete customer data at any time and without giving reasons, or to block a user name and password.
The data collected by JOT in connection with the conclusion of the contract is collected, processed and used for the purpose of fulfilling the obligations arising from the sales contract; JOT draws the customer’s attention to the fact that this data may also be used for marketing purposes. This information is not communicated to third parties, with the exception of JOT’s partners for operational purposes.
The list of products presented on the www.justontime.ch website does not in itself constitute a legally binding offer. These products belong to JOT and its partners who are responsible for preparing them for delivery.
By sending the order, choosing the payment method, selecting the delivery method and simultaneously accepting these GTC, the customer makes a legally binding offer to enter into a contract. The contract with JOT is concluded as soon as JOT sends an order confirmation to the customer. The confirmation specifies the delivery terms and deadlines; these deadlines are not binding and are not guaranteed by JOT.
JOT draws the customer’s attention to the fact that the conclusion of the contract is subject to the availability of articles or products from its suppliers.
Any request for information on a product or request for a quotation from a customer is not considered as an offer from JOT.
Products are delivered in accordance with the presentation in the form of a digital photograph displayed on the www.justontime.ch website, subject to slight differences in size, colour, structure and finish. In the case of subsequent or additional orders, JOT reserves the right to make any deviations in size, colour, structure and finish in relation to products delivered with previous orders.
The decorative items and accessories shown in the photograph of a product do not form part of the product, unless they are expressly included in the product description.
Unless otherwise confirmed in writing, the products presented by JOT are intended for end customers for private use only. In particular, they are not suitable for commercial use.
Any use of the site for professional or commercial purposes to resell the items to third parties is strictly forbidden. In the event of non-compliance with this clause, the customer is liable to immediate exclusion; in all cases, JOT reserves the right to bring an action for damages.
All prices quoted are net prices, including VAT and shipping costs. Delivery costs are added to the product price. Article 7, paragraph 3 of these GTC is reserved.
Prices are quoted and payable in Swiss francs (CHF). The time of dispatch of the order by the customer is decisive in determining the price.
JOT may change prices at any time without prior notice.
JOT accepts the methods of payment offered to the customer at the time of ordering. The product will only be delivered once full payment has been received by JOT.
At any time, customers with an account on www.justontime.ch can consult the summary of their orders in their customer area.
The products ordered will be delivered to the address given by the customer at the time of ordering. Delivery is only made within Switzerland.
Delivery may also consist of several partial deliveries. In this case, JOT will cover the additional costs incurred.
Deliveries are made by JOT. The customer is informed in advance of the delivery date.
The product may be left at the customer’s home, even in the customer’s absence.
The products are delivered within the delivery times stated in the order confirmation. All data relating to delivery times are non-binding and without guarantee on the part of JOT. These data may change at any time and without notice. JOT cannot be held liable for any compensation in the event of late delivery.
If a product ordered is no longer available, the payment made by the customer will be reimbursed by JOT.
Until full payment of the sale price, the product remains the property of JOT or its suppliers. JOT is entitled to register this reservation of ownership without the customer’s assistance in the register of reservation of ownership agreements competent for his domicile.
The customer undertakes to check on receipt that the products delivered are correct, complete and in good condition.
JOT and its partners will not be held responsible for any defects that the customer has noticed or could have noticed on receipt of the products and that they did not report and mention on the delivery note/receipt report as soon as they were discovered.
In addition, at the time of delivery, if a package is delivered in a defective condition, the customer is required to obtain a damage certificate from the JOT delivery person.
Provided that they could not have been noticed beforehand, JOT and its partners assume responsibility for defects noticed after receipt, on the express condition that they are reported to JOT or its partner in writing, as soon as they are discovered and during the guarantee period.
10. Warranty conditions in the event of defects
In the absence of any agreement to the contrary, JOT and its partners offer, in accordance with the law, a two-week guarantee on the purchased product, starting from the delivery of the product to the customer.
All damage due to wear and tear, ageing and improper use, as well as light bulbs, are excluded from the guarantee. Any transformation or modification of the product by the customer will invalidate the guarantee.
In the event of a defect, the Customer may, at his discretion, request the free repair of the product, request a reduction in the price corresponding to the loss in value, withdraw from the contract or request a replacement delivery.
Unless otherwise agreed, the customer cannot cancel the execution of the order once it has been confirmed by JOT. Delivered products are not taken back by JOT.
JOT and its suppliers are the sole holders of the copyright protecting the www.justontime.ch website and its content, such as texts, photos, graphics, etc. It is forbidden, without the prior written consent of JOT, to copy, download or use parts of this website. Special links available for downloading are excluded.
JOT expressly reserves the right to adapt or modify these GTC at any time according to circumstances and to apply them directly.
Only Swiss law is applicable.
